
Bail Granted with Unconventional Terms
In a remarkable ruling, the High Court of Orissa has granted bail to a bank loan defaulter under the unusual condition that she must clean a bank branch for two hours each day over the next two months. This decision was made by a vacation bench led by Justice SK Panigrahi on Tuesday. The court instructed Manogyan Patnaik, a resident of Cuttack, to clean the ICICI Bank’s Link Road Branch daily from 8 AM to 10 AM. Patnaik had been in custody since her arrest on February 5 by the Economic Offences Wing (EOW) of the state Crime Branch, facing allegations of fraudulently obtaining multiple loans from ICICI Bank and Indian Bank by mortgaging the same property multiple times and subsequently selling it to another individual who also secured a loan on it.
Without delving into the specifics of the case, Justice Panigrahi approved Patnaik’s bail request, stipulating that her release would come with strict terms and conditions as determined by the trial court, in addition to those set by the High Court.
The court emphasized that Patnaik must refrain from engaging in any criminal activities while on bail and must not interfere with any evidence related to the prosecution. The order explicitly stated, "The petitioner shall approach the ICICI Bank and clean the bank premises," warning that any breach of these conditions could lead to the revocation of her bail. Furthermore, the High Court instructed local police to collaborate with bank officials to ensure compliance with the bail conditions.
