On Sunday, Kolkata Police issued a statement to dispel false rumors circulating on social media regarding the arrest of law student Sharmistha Panoli. The police clarified that claims of her unlawful detention for opposing Pakistan are unfounded, labeling these narratives as 'mischievous and misleading.' Panoli was apprehended in Gurugram on Friday night and subsequently placed in 14 days of judicial custody by the Alipore Court.

Details of the Case Against Panoli
Kolkata Police reiterated that the case against Panoli was initiated based on allegations that she shared a video deemed offensive to the religious sentiments of a specific community. The police confirmed that the case was filed under the relevant sections of the Bhartiya Nyaya Sanhita (BNS).
The police statement elaborated, 'A case was registered at Gardenreach PS on May 15, 2024, due to allegations that she posted a video promoting disharmony and hatred among communities. Despite multiple attempts to serve her notice, she was consistently found to be absconding.'
Lawful Arrest Procedure Followed
The police explained that after an arrest warrant was issued, Panoli was lawfully apprehended in Gurgaon during daylight hours. She was then presented before the appropriate magistrate and granted transit remand in accordance with legal protocols. The court later ordered her to be placed in judicial custody.
Kolkata Police also stressed that hate speech and abusive language are serious offenses and should not be confused with the right to free speech as outlined in Article 19(1)(a) of the Constitution. They clarified that Panoli's arrest was not due to her patriotic expressions but rather for disseminating content that incites hatred among communities. The police urged the public to act responsibly and avoid actions that could aid adversaries.
